SMS Terms & TCPA Disclosure

Last updated

This page explains how text messaging works on TradeTendr: who is sending the messages, how consent is obtained, and how to stop receiving them. If you got a text and want it to stop right now, reply STOP to that message. It stops immediately and permanently.

Who sends messages

TradeTendr is software used by independent contracting businesses, roofers, siding and window installers, and similar trades. When you receive a text message sent through TradeTendr, the sender is the contractor you contacted, not TradeTendr. The contractor decides what to send and when. TradeTendr is the platform that delivers it on their behalf.

The contractor's business name appears in the consent disclosure you agreed to and in the messages themselves.

Consent is opt-in only, and it is never a condition of getting a quote.

When you request an estimate through a TradeTendr quote widget on a contractor's website, there is a checkbox beside the phone number field. That box is unchecked by default. You receive text messages only if you tick it yourself. Declining costs you nothing, your estimate is delivered either way.

The disclosure beside that checkbox reads, with the contractor's name filled in:

Text me about my quote. By checking this box, I agree to receive text messages from [Contractor Name] about my estimate and related follow-up. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help.

A contractor may also enroll you if you have an existing business relationship with them. for example, if you are already a customer or gave your number during an in-person visit. In that case the contractor is responsible for having obtained your permission.

Message types

Messages sent through TradeTendr relate to work you asked about. Typically:

  • Confirmation that your estimate request was received
  • Follow-up on an estimate you have not responded to
  • Answers to questions you send back
  • Appointment reminders and scheduling
  • Requests for a review after work is completed

TradeTendr does not send marketing messages on its own behalf, and your number is never sold or shared with third parties for their marketing.

Frequency and cost

Message frequency varies depending on the contractor and where you are in the process. A typical follow-up sequence is three to five messages over a couple of weeks, and it stops as soon as you reply.

Message and data rates may apply. TradeTendr and the contractor do not charge you for messages, but your mobile carrier may, depending on your plan.

Messages are not sent during quiet hours. Anything scheduled to go out overnight is held until the following morning in your local time zone.

Stopping messages

Reply STOP to any message. You will get one confirmation that you have been unsubscribed, and then nothing further. We also honour the standard variants: STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT.

Opting out takes effect immediately and cancels any follow-up sequence already scheduled. It applies to that contractor. If you have dealt with more than one business using TradeTendr, you would need to reply STOP to each, they are separate senders.

You can also email support@tradetendr.com from any address with the phone number you want removed, and we will remove it.

Getting help

Reply HELP to any message for sender information and support contact details. For anything else, email support@tradetendr.com.

What we record

When you give consent we store a record of it, because we need to be able to show what you agreed to. That record contains:

  • Your phone number
  • The exact wording of the disclosure shown to you, as displayed at the time
  • The date and time you consented
  • The IP address and browser the request came from
  • The page you were on

We keep consent records after you opt out. This is deliberate: an opt-out record on its own does not show that consent was properly obtained beforehand, and we may need to demonstrate that. Opting out prevents further messages regardless.

For contractors using TradeTendr

If you use TradeTendr to send messages to your customers, you are the sender and you carry the legal responsibility for those messages under the Telephone Consumer Protection Act and equivalent state law. That means:

  • Do not import a list of numbers you cannot demonstrate consent for. Purchased or scraped lists are a fast route to a complaint and to losing your carrier registration.
  • Do not disable or reword the consent checkbox to make it easier to collect numbers.
  • Honour opt-outs. The platform enforces this automatically; do not attempt to work around it.
  • Keep your messages relevant to the work the customer contacted you about.

TCPA penalties are assessed per message and are substantial. The platform is built to keep you on the right side of it, but the obligation is yours.
